However, according to the law on confidence in the digital economy, the host cannot be held liable for the stored content if it was not aware of its illicit nature. To frame the parties' liability, it is advisable to include a clause limiting liability. Note that this clause must not deprive the provider's obligations of their substance (Article 1171 of the Civil Code).
